Comment 2: Regarding the role of DWI defense attorneys.
How do
you feel about DWI defense attorneys’ ethical obligation of having to
zealously defend people charged with DWI?
"What defense? How can it be defended?
If you are on the road driving while intoxicated, what is the defense? You are clearly and blatantly breaking the law.
Extenuating circumstances such as sitting behind the wheel but not driving, etc. whose to say you would not have taken
off driving at some point. "
-----
"I think they are defending people who made a mistake and deserve their 'day in
court' just like any other citizen. For the most part, they are not evil criminals,
but they do need representation."
-----
"police and prosecuters are trying
zealously to convict. citizens deserve the right to be zealously
defended."
-----
"There should always be someone to
help the commen man, instead of having self rightious men whos kid
probably got off of a DUI charge because they belong to the procecutors
office."
-----
"Attorneys zealously defend murderers,
rapists and white collar criminals--why not defend someone with an
illness such as alcoholism?"
-----
"Yes. The current system creates inequities due to "professional courtesies" one
prosecutor grants to another."
-----
"its all about money."
-----
"attorneys find all these all wrong doing by police officers and the procedure they use to arrest someone.
yet, in court the police officers always offer a different story--and at the end their procedure is always right"
-----
"SHARKS"
-----
"most dwi attorneys are
in it for the money because they know it is very hard to win a dwi case
especially when a breathalyzer was done. But an attorney can buy time by
delaying trial and giving their clients a chance to get their affairs
together."
--------------------------------
"mine wasnt very zealous
for $4,000."
---------------------------------
"ALLWAYS HAVE ATTORNEY
WHEN CHARED WITH DUI"
-----------------------------------
"I think that every case has to be given serious consideration, and every
person who is charged, the court has to look at the profile of the person.
It is very unfortunate that in certain cases,it takes a large fee to prove that a
persons well being, and property has been violated"
------------------------------------
"THEY ARE ALL THE SAME."
-------------------------------------
"DWI defense attorneys should zealously defend their clients just
as they would with any other type charges. But the reality is that they don't. I have a strong case that the officer didn't have
probable cause to stop me and the location of the stop is falsified as well. Yet my lawyer still advised me to plead guily. I have been
told by several lawyers if the Judge feels I am wasting his time by choosing to defend myself, I may receive more than the minimum
sentence. Is this still America or are we living in a police state now."
-------------------------------------
"If the defendant maintains he/she was no impaired, then the
case should be defended. However, if the defendant was quite obviously drunk (super-high BAC, evidence of associated accident,
open/empty containers in car), statements by the defendant admitting impairment, then perhaps the case shouldn't be
defended in that regard."
---------------------------------------
"Rarely does the defendant get
up and say he is innocent, but rather the cop is put on trial and it is
argued that he did everything wrong. Its getting a little ridiculous.
---------------------------------------
"They should be adequately and
zealously defended in cases where one one was injured."
-----------------------------
"I believe that Dwi defense
attorneys do have an ethical obligation to defend their clients to the
best of their abiliyies. Law enforcement officials should be required
to strictly follow every protocol set when making an arrest, and
the motorist charged with DWI has every right to defense whether or
not an error is made by the arresting officer."
-----------------------------
"Yes, but there must be a point
when the attorney knows that case will result in a guilty plea and not
continue to rack up billable hours. Just beginning the process I can't
accurately express examples. This is just a feeling and it may be
answered during my 1st meeting the my attorney"
------------------------------
"My lawyer charged me $3000.00
for nothing. Bunch of false hopes is all i got and 10 years without
driving. I was wrong for what i did, but the lawyers are thiefs."
-----------------------------
"They dont do very much for DUI
cases anyways. Unless its homicide with a motor vehical."
------------------------------
"Ilove it.you and my experience
with cases of this magnatude tell me these cases need to be treated as
a criminal case because most people don't know ,that most people in
jail today when , assuming they committed the cime did it while they
were high and most don't even remember what happened ,even if it
wasn't them or the facts were distorted."
------------------------------
"If lawyers want to "all
of a sudden become ethical or moral" than they should look too
who they are going to represent in a child molestation case first. If
the money is there, it seems ethics go right out the window (i.e. OJ),
Claus von Bulow, Ted Kennedy (Chappaquidac) Ivan Boesky , Michael
Millken " do you see where I'm going with this Counselors
"????? A SLAP ON THE WRIST FOR THE WEALTHY, A JAIL CELL FOR THE
REST OF US."
---------------------------------
"I feel that attorneys are
obligated to defend their clients zealously. We go by the law and
motto "Innocent until proven guilty", not the other way
around."
----------------------------------
"I feel attorneys take peoples
money knowing they aren't going to win."
-----------------------------------
"They should zealously defend
people charged with DWI's as they would any other "crime".
"
------------------------------------
"All citizens are entitled to a
zealous defense."
